Terms of Service

You retain all rights to the content you upload to the Service ("User Content"). By uploading content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, display, and distribute your content solely for the purpose of providing and improving the Service.

You agree not to upload, post, or transmit content that:

• Violates any law or regulation
• Infringes on intellectual property rights of others
• Contains viruses, malware, or other harmful code
• Is obscene, pornographic, or sexually explicit (except for legitimate professional photography)
• Contains hate speech, harassment, or discriminatory content
• Promotes violence or illegal activities
• Violates the privacy rights of others
• Is spam or unauthorized commercial content

You are solely responsible for your User Content and the consequences of posting or publishing it. We do not endorse any User Content or opinions expressed by users.

We reserve the right (but have no obligation) to monitor, review, and remove any User Content that violates these Terms or that we find objectionable.

We offer various subscription plans with different features and storage limits. Current pricing is available on our pricing page. We reserve the right to change prices at any time with reasonable notice.

Subscription fees are billed in advance on a monthly or annual basis. You authorize us to charge your payment method for all fees. If automatic billing fails, we may suspend your account.

Subscription fees are non-refundable except as required by law or as otherwise stated in these Terms. We may offer refunds on a case-by-case basis at our sole discretion.

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. You will continue to have access to paid features until the end of that period.

We may offer a free trial period for certain plans. At the end of the trial, your account will automatically convert to a paid subscription unless you cancel before the trial ends.

The Service and its original content (excluding User Content), features, and functionality are owned by PickIMG and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

PickIMG, our logo, and other marks are trademarks of PickIMG. You may not use these trademarks without our prior written permission.

We respect the intellectual property rights of others. If you believe your work has been copied in a way that constitutes copyright infringement, please contact us at [email protected] with:

• Identification of the copyrighted work
• Identification of the infringing material
• Your contact information
• A statement of good faith belief
• A statement of accuracy under penalty of perjury
• Your physical or electronic signature

The Service is provided "as is" and "as available" without warranties of any kind. We do not guarantee that the Service will be uninterrupted, secure, or error-free.

To the maximum extent permitted by law, PickIMG shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or other intangible losses resulting from:

• Your use or inability to use the Service
• Unauthorized access to your account or data
• Errors, mistakes, or inaccuracies in the Service
• Personal injury or property damage from your use of the Service

While we make regular backups of user data, you are responsible for maintaining your own backups of your content. We are not responsible for any data loss.

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where PickIMG is registered, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration, except that either party may seek injunctive relief in court.

You agree that any arbitration or proceeding shall be limited to the dispute between you and PickIMG individually. You waive the right to participate in a class action lawsuit or class-wide arbitration.

These Terms constitute the entire agreement between you and PickIMG regarding the Service and supersede any prior agreements.

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms at any time without restriction.
